After the stop of the enforcement proceedings issued by the Court as a collateral measure in a proceeding for a declaratory claim for property there is a ban on every action related to the transfer of the possession of the property which is the subject of the proceedings including actions of enforced taking which categorically cannot be done given that the proceeding of the enforcement case is stopped. The imposed collaterals in the enforcement case including the ban remain effective but from the moment the decree of the enforcement proceedings is stopped the taking is stopped as well. Or said in another way, the ban on the property remains effective but the taking will not be executed until the cause for the enforcement proceedings is eliminated.
